Completing the transaction

You are now on the final stretch of your home buying process. At this stage the final item on your buyer's agenda should be to complete all the legal formalities pertaining to the transaction.

Here is a closing checklist that will guide you through the final steps:

  1. Set up a closing date. Consult the seller, the bank and your attorney (Notary Public)
  2. Set up the venue and the time.  Today, most transactions take place in banks. Most banks willingly facilitate these kinds of transactions by providing a special place, staff and cash counting machines etc. It is prudent to take this option especially if the full consideration or a part thereof is payable by cash. Banks provide the best and most secure environment for the purpose.
  3. Make prior arrangement with the bank if a large amount of money is to be withdrawn. The bank will have your cash ready and disburse to you in private.
  4. The seller has the right to know the authenticity of the draft by calling the issuing bank before placing his signature on the deed of conveyance if the consideration is fully or partly paid by a bank draft (Manager’s cheque).
  5. The seller is expected to carry a large amount of cash with him/her if the consideration is fully or partly paid in cash and the arrangements must be discussed and mutually agreed prior to the closing date.
  6. Ensure the draft deed of conveyance is approved by the seller at least one day prior to the closing date.
  7. Witnesses must be known to the Notary attesting the deed of transfer. It is best if you can find two witnesses known to the seller as well as to your Notary.
  8. Keep cash ready for the legal fees and stamp duty.
  9. Ensure that the lending institution is ready with the mortgage bond and the necessary bank drafts to be released to the seller.(if applicable)
  10. Obtain an acknowledgement from the seller for the consideration paid.
  11. Obtain proof of identity (photocopy of NIC or Passport) from all signatories to the sale, including witnesses.
  12. Take over originals of all previous deeds and documents.
  13. Take over keys and vacant possession of the home.
